Regulation for Intellectual Property Rights

OBJECTIVE

The JSSAHERM strives to support and encourage its faculty and students in securing commercial development of intellectual property resulting from their research to benefit the society. Staff is encouraged to develop their inventions consistent with the academic mission of the JSSAHERM.

1. PERSONS COVERED

This policy governs all persons at the JSSAHERM, including full- and part-time faculty, visiting faculty, students (both undergraduate and graduate) and doctoral scholars.

2. INTELLECTUAL PROPERTY

Intellectual property of JSSAHERM includes not only inventions, discoveries, creations, or authored works which may be protected legally, such as patents and copyrights, but also the physical or tangible embodiment of the technology, such as biological organisms, plant varieties, or software.

Intellectual property generated shall be of two types.

  • UNENCUMBERED
    Developed through wholly or partly in-house R & D programmes/ projects. In such cases ownership of intellectual property is solely that of JSSAHERM, and consequently the licensing rights are that of JSSAHERM alone.

    Intellectual property developed through contract research and subsequently rendered unencumbered as per contractual arrangement with the client. In such cases, licensing of intellectual property by JSSAHERM would be in accordance with the terms and conditions agreed upon with respect to third party licensing with the client.

  • ENCUMBERED

    Developed through contract research, i.e., total or partial financial support, and with/without technical inputs from users/ clients. In such cases, ownership and licensing of intellectual property for commercial utilization shall be governed by JSSAHERM obligations to client in the matter.

3. IPR POLICY

  • The JSSAHERM owns all rights to all patentable inventions arising from the research Work.
  • The JSSAHERM will normally make an initial decision whether to pursue a patent or other legal protection for the potential invention.
  • The students shall treat as confidential all knowledge and information relating to any work taking place within the JSSAHERM.
  • A student shall not publish any work which might prejudice the exploitation of the rights to which these Regulations apply, without the consent of the JSSAHERM.
  • The JSSAHERM reserves the right to negotiate the sharing and exploitation of the IP with the student, supervisor, employer of the student, sponsors or third parties on such terms and conditions it may deem fit
  • The JSSAHERM shall be responsible for the legal protection of the rights where the JSSAHERM holds any interest in such rights
  • It shall be a condition of registration of a student to transfer or assign to the JSSAHERM, the intellectual property rights rising out of his programme of study or research. This include
    1. The ownership of and the sole right to exploit any patentable invention or discovery;
    2. All rights in any design produced; and copyright in any computer program and any design capable of commercial exploitation produced by the student in the programme of study or research.
